TERM
This license is effective until terminated. You may terminate it by destroying the program and documentation and all copies thereof. This license will also automatically and irrevocably terminate if you fail to comply with any term or condition of this Agreement. Upon any termination you agree to destroy all copies of the program and documentation in your possession.
EXPORT LAWS; GOVERNMENT USERS
You agree and certify that neither the software nor any other technical data received from DataViz, nor the direct product thereof, will be exported outside the United States except as authorized and as permitted by the laws and regulations of the United States.
If you are licensing the program on behalf of any unit or agency of the United States Government, the following provisions apply. The Government agrees: (i) if the program is supplied to the Department of Defense (DoD), the program is classified as "Commercial Computer Software" and is subject to the following RESTRICTED USE LEGEND -- Use, duplication or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013; and (ii) if the program is supplied to any unit or agency of the United States Government other than DoD, the Government's rights in the program and its documentation will be as defined in Clause 52.227-19(c)(1) and (2) of the FAR, or in the case of NASA, in Clause 1852.227-86(d) (1) and (2) of the NASA Supplement to the FAR.
GENERAL
This License Agreement shall be governed by the laws of the State of Connecticut without regard to principles of conflicts of laws and shall inure to the benefit of DataViz, its successors and assigns. Any dispute relating hereto shall be adjudicated in the state or federal courts in the State of Connecticut, and you hereby consent to the jurisdiction of said courts for any such disputes. If any provision hereof is unenforceable, that provision shall be enforced to the maximum extent permissible and the remainder of this License Agreement shall continue in full force and effect.
